          These Terms and Conditions are valid for the website "lostfoundperson.com".

  Definations :

          The following definations is being used in these Terms and Conditions. These definations are valid only for these Terms and Conditions :

1. Portal : "Portal" means "lostfoundperson.com" website and its technical specifications & programming.
2. Admin : "Admin" means jointly the administrator of the "Portal" namely Rahul Sharma, any operating agency of the "Portal"  and the "Portal".
3. Volunteer : "Volunteer" means any person, organisation or agency who is registerd as volunteer on the "Portal" or/ and to whom an authentic Login ID and Password has been issued by the "Admin".
4. User : "User" means anyone who works on the "Portal" including "Volunteer".
5. Information : "Information" means the displayed details about any lost or/ and found person provided by "Admin"/ "User" on the "Portal".
6. Content : "Content" means every matter on the "Portal" including "Information"

  General Terms and Conditions :

1. The "Portal"  is a social initiative to share the details of lost or/ and found persons with public.
2. The "Information" means providing/ declaring/ sharing all the relevant details with regards to the lost/ found person as collected by the "User" to best of his knowledge to share the information as a social cause to towards the society.
3. The "Volunteer"s are consenting for receiving notifications from the "Admin". These notifications will be sent to the "Volunteer"'s E-mail and/ or on Landline/ Mobile from authorized number via SMS/ IVR/ Telephone calls etc.
4. This "Portal" is used to help people in finding missing persons and for this purpose, the "Information" is provided by "User". However, in the event if it is discovered that certain "Information" has been wrongly/ inaccurately displayed, we will not be able for any claim for damages from anyone. Incase, if any person has knowledge of the inaccuracy or intangibility of a case, it may be kindly be brought to our notice and we would rectify/ remove/ amend the "Content".

Legal Terms and Conditions :

1. The "User"  is prohibited from uploading or sharing any detail on the "Portal" that is unlawful or misleading. Uploading any obscene or indecent picture/ vedio/ unlawful details by the "User" on the "Portal"  will attract serious criminal liability.
2. Any fact/ detail of any type crime/ offence committed by such lost or found person or aggrieved by such lost or found person is prohibited to provide by the "User" on the "Portal"
3. "Information" is only for the social purpose and not for any illegal uses. Anyone misusing the "Information" for any illegal purpose, than he shall be responsible under the law and "Admin"/ "Volunteer" shall not be responsible.
4. Using the "Content" for any commercial purpose or any derivative work or misuse of any kind is strictly prohibited and may invite legal consequences.
5. The "Admin" reserves the right to remove any "Content" from the "Portal"  without any notice and any time.
6. The "Admin" is not responsible for any interaction/ passing of the "Information"(s).
7. The "Admin" is not responsible for any disputes arising between the "User"s  and has no obligation to moniter any such disputes and shall not be party to such dispute/ litigations.
8. The "Admin"  reserves the right to verify the authenticity of the "Content". If any "Content" has been found false or unlawful, the "Admin"  in its sole discretion, remove such "Volunteer" /account/ "Content" and take appropriate action under the provision of law.
9. Through this "Portal" you are able to link to other websites which are not under the control of the "Admin"  and does not have any control over the nature, matter and availability of those websites.
10. The "Admin" will not be held any responsibility in any case to register FIR related to the "Information". The "Admin" is not responsible for non-registration of FIR in any such case.

  Technical Terms and Conditions :

1. The "Admin" cannot guarantee the security of the "User". The "Admin" is not responsible for any disclosure about any details of the "User".
2. The "Admin" will not be liable under any circumtances for any type expences, losses or damages with the use of the "Portal".
3. The inclusion of any links of other websites on the "Portal"  does not necessarily imply a recommendation or endorse the views of expressed therein.
4. Every effort is made to keep the "Portal"  up and running smoothly. However the "Admin" takes no responsibility for, and will not be liable for, the "Portal" being temporarily unavailable due to technical issues beyond its control.

  Legal Juridiction

          These Terms and Conditions shall be governed by and constructed in accordance with the Indian Law. Any dispute arising related to the "Portal" shall be subject to the jurisdiction of the appropriate court situated in Jaipur City (Rajasthan, India) only.

वैद्यता :

          ये नियम और शर्तें वेबसाइट "lostfoundperson.com" के लिए वैद्य हैं। 

परिभाषायें :

          इन नियम एवं शर्तों में निम्‍नांकित परिभाषाऐं प्रयुक्‍त की जा रही हैं। ये परिभाषाऐं केवल इन नियम एवं शर्तों के लिए ही वैद्य हैं :

1. पोर्टल : "पोर्टल" से तात्‍पर्य "lostfoundperson.com" वेबसाइट तथा इसकी तकनीकी विशेषताऐं व प्रोग्रामिंग से है।
2. एडमिन : "एडमिन" से संयुक्‍त रूप से तात्‍पर्य ''पोर्टल'' के एडमिनिस्‍ट्रेटर (जिसका नाम राहुल शर्मा है), ''पोर्टल'' को ऑपरेट करने वाली कोई एजेन्‍सी एवं ''पोर्टल'' से है।
3. स्‍वयंसेवक : "स्‍वयंसेवक" से तात्‍पर्य किसी ऐसे व्‍यक्ति, संस्‍था या एजेन्‍सी से है जो ''पोर्टल'' पर वॉल्‍युन्‍टीयर (volunteer) के रूप में रजिस्‍टर्ड है और/ या जिसे ''एडमिन'' के द्वारा एक वैद्य लॉगइन आईडी एवं पासवर्ड जारी किया गया है।
4. उपयोगकर्ता : "उपयोगकर्ता" से तात्‍पर्य ''स्‍वयंसेवक'' सहित उस प्रत्‍येक व्‍यक्ति, संस्‍था या एजेन्‍सी से है जो ''पोर्टल'' पर कार्य करता है।
5. सूचना : "सूचना" से तात्‍पर्य "एडमिन"/ ''उपयोगकर्ता'' द्वारा ''पोर्टल'' पर किसी खोये हुए और/ अथवा पाये हुए किसी व्‍यक्ति के बारे में उपलब्‍ध कराई गई जानकारी से है।
6. कन्‍टेन्‍ट : "कन्‍टेन्‍ट" से तात्‍पर्य ''पोर्टल'' पर उपलब्‍ध प्रत्‍येक सामग्री से है, जिसमें ''सूचना'' भी सम्मिलित है।

सामान्‍य नियम एवं शर्तें :

1. ''पोर्टल'' खोये हुए अथवा/ और पाये हुए व्‍यक्तियों की जानकारी आम जनता के साथ शेयर करने का एक सामाजिक प्रयास है।
2. ''सूचना'', ''उपयोगकर्ता'' द्वारा एकत्रित की जाकर सामाजिक उद्देश्‍य की प्राप्ति हेतु 'पोर्टल'' पर उपलब्‍ध कराई/ शेयर की जाती है, जो ''उपयोगकर्ता'' की जानकारी एवं विश्‍वास में पूर्ण सत्‍य व सही होनी चाहिए। ''सूचना'' आम जनता द्वारा उपलब्‍ध तथ्‍यों के आधार पर उपलब्‍ध कराई जाती है।
3. ''स्‍वयंसेवक'' ''एडमिन'' द्वारा भेजे जाने वाले नोटिफिकेशन्‍स प्राप्‍त करने के लिए सहमत है। ये नोटिफि‍केशन्‍स ''स्‍वयंसेवक'' के ई-मेल अथवा/ और मोबाइल/ लैण्‍डलाइन फोन पर अधिकृत नम्‍बर से एसएमएस/ आईवीआर/ टेलीफोन कॉल्‍स के माध्‍यम से भेजे जायेंगे।
4. ''पोर्टल'' का उपयोग ''उपयोगकर्ता'' द्वारा उपलब्‍ध कराई गई ''सूचना'' के आधार पर खोये हुए व्‍यक्तियों को ढूंढने में किया जाता है। फिर भी यदि यह पाया जाता है कि कोई ''सूचना'' गलत/ त्रुटिपूर्ण प्रदर्शित हो रही है, तो इसके लिए 'पोर्टल''/"एडमिन" किसी प्रकार के नुकसान/ क्षतिपूर्ति/ दावे के लिए जिम्‍मेदार नहीं होगा। यदि किसी भी ''कन्‍टेन्‍ट'' में किसी प्रकार की त्रुटि/ गलती किसी व्‍यक्ति की जानकारी में आती है, तो उनसे निवेदन है कि वे इसे हमारी जानकारी में लायें और हम ऐसे गलत/ त्रुटिपूर्ण ''कन्‍टेन्‍ट'' को संशोधित करेंगे/ हटायेंगे।

विधिक नियम एवं शर्तें :

1. ''उपयोगकर्ता'' ''पोर्टल'' पर ऐसी कोई भी जानकारी अपलोड या शेयर नहीं करे जो अवैधानिक या गुमराह करने वाली हो। ''पोर्टल'' पर ''उपयोगकर्ता'' द्वारा किसी प्रकार की अभद्र या अश्‍लील या अवैधानिक फोटो/ विडियो/ जानकारी अपलोड या शेयर किया जाना गंभीर आपराधिक दुराचरण माना जायेगा।
2. खोये हुए या पाये हुए किसी व्‍यक्ति द्वारा कारित किये गये अथवा खोये हुए या पाये हुए किसी व्‍यक्ति के साथ घटित हुए किसी अपराध/ घटना से संबंधित तथ्‍य/ जानकारी ''उपयोगकर्ता'' ''पोर्टल'' पर अपलोड/ शेयर नहीं करे।
3. ''सूचना'' किसी अवैधानिक उपयोग के लिए ना होकर केवल सामाजिक उद्देश्‍य की प्राप्ति के लिए है। यदि कोई व्‍यक्ति ''सूचना'' का किसी गैरकानूनी उद्देश्‍य से दुरुपयोग करता है, तो वह स्‍वयं विधि के प्रावधानों के अनुसार इसके लिए उत्‍तरदायी होगा और ''पोर्टल''/''एडमिन'' इसके लिए जिम्‍मेदार नहीं होगा।
4. किसी वाणिज्यिक प्रयोजन अथवा किसी प्रकार के गलत उपयोग हेतु ''कन्‍टेन्‍ट'' का उपयोग करना मना है तथा ऐसा किये जाने पर सक्षम विधिक कार्यवाही की जा सकती है।
5. बिना किसी पूर्व नोटिस के किसी भी समय ''पोर्टल'' से कोई भी ''कन्‍टेन्‍ट'' हटाने का सर्वाधिकार ''एडमिन'' के पास पूरी तरह सुरक्षित है।
6. ''सूचना''/ ''सूचनाओं'' के किसी भी प्रसारण के लिए ''एडमिन'' उत्‍तरदायी नहीं होगा।
7. ''उपयोगकर्ताओं'' के मध्‍य उत्‍पन्‍न किसी विवाद के लिए ''एडमिन'' उत्‍तरदायी नहीं होगा और ना ही ऐसे किसी विवाद को मॉनिटर करने का दायित्‍व ''एडमिन'' का होगा और ना ही ऐसे किसी विवाद/ याचिका में ''एडमिन'' पक्षकार होगा।
8. ''एडमिन'' के पास ''कन्‍टेन्‍ट'' की सत्‍यता जॉंचने के सर्वाधिकार सुरक्षित हैं। यदि कोई ''कन्‍टेन्‍ट'' झूठा, गलत या गैरकानूनी पाया जाता है, तो ''एडमिन'' अपने स्‍वविवेक से ऐसे ''स्‍वयंसेवक''/ विवरण/ ''कन्‍टेन्‍ट'' को ''पोर्टल'' से हटा सकेगा तथा विधि के प्रावधानों के अनुसार सक्षम कार्यवाही कर सकेगा।
9. इस ''पोर्टल'' के जरिये ''उपयोगकर्ता'' अन्‍य वेबसाइट्स पर जा सकता है। ये अन्‍य वेबसाइट्स ''एडमिन'' के नियंत्रण में नहीं हैं और इनकी प्रकृति, इन पर अंकित विवरण एवं इनकी उपलब्‍धता पर ''एडमिन'' का कोई नियंत्रण नहीं है।
10. ''सूचना'' के संबंध में किसी भी प्रकार की प्रथम सूचना रिपोर्ट (एफ.आई.आर.) दर्ज कराने का किसी भी परिस्थिति में ''एडमिन'' का कोई उत्‍तरदायित्‍व नहीं होगा। ऐसे किसी मामले की प्रथम सूचना रिपोर्ट दर्ज नहीं होने के लिए ''एडमिन'' किसी भी प्रकार से उत्‍तरदायी नहीं होगा।

तकनीकी नियम एवं शर्तें :

1. ''एडमिन'' ''उपयोगकर्ता'' की किसी भी प्रकार की सुरक्षा की कोई गारंटी नहीं देता है। ''उपयोगकर्ता'' की किसी भी प्रकार की कोई जानकारी प्रकट होने के लिए ''एडमिन'' उत्‍तरदायी नहीं होगा।
2. ''पोर्टल'' के उपयोग के कारण किसी भी प्रकार की क्षति, खर्च या नुकसान के लिए ''एडमिन'' किसी भी प्रकार से किसी भी परिस्थिति में उत्‍तरदायी नहीं होगा।
3. ''पोर्टल'' पर अन्‍य वेबसाइट्स के लिंक का समावेश किये जाने का यह अर्थ नहीं है कि ''एडमिन'' ऐसी किसी वेबसाइट के/ में उपलब्‍ध विचारों का समर्थन करता हो/ सिफारिश करता हो।
4. ''पोर्टल'' को बिना किसी बाधा के संचालित करने के हरसंभव प्रयास किये गये हैं, परन्‍तु फिर भी नियंत्रण से परे किसी तकनीकी समस्‍या के कारण अस्‍थाई रूप से ''पोर्टल'' की अनुपलब्‍धता के लिए ''एडमिन'' उत्‍तरदायी नहीं होगा।

विधिक क्षेत्राधिकार :

          ये नियम और शर्तें भारतीय कानून की सीमा में परिबद्ध एवं भारतीय कानून के अनुसार बनाई गई हैं। ''पोर्टल'' से संबंधित किसी भी प्रकार का विवाद उत्‍पन्‍न होने की स्थिति में जयपुर शहर (राजस्‍थान, भारत) में स्थित सक्षम न्‍यायालय में सुनवाई का क्षेत्राधिकार निहित होगा।
